Currently only 18 states have fertility insurance coverage laws, and eight states have fertility preservation laws for iatrogenic (medically-induced) fertility.
You were just diagnosed with cancer… and life saving treatment could impact your future ability to have a baby. Imagine you are a woman seeking to undergo fertility preservation following a new diagnosis and your insurance company deems this procedure to be “elective”!?
As if you’d “elect” to have cancer? Politely put…WTF!? This can’t be right!
Unfortunately, in 32 of the 50 states in the U.S, this is the current reality for women seeking to put their eggs on ice for future use after their their cancer chapter is closed. NEW YORK
Thanks to your advocacy, New York has expanded fertility preservation coverage to include Medicaid patients. Governor Hochul’s approved 2025 budget ensures broader access to important care for cancer patients in need through bill A2686.
GEORGIA
On May 1, 2025, Governor Kemp signed HB94 into law, mandating private insurance companies in Georgia cover the cost of fertility preservation services for medically necessary treatment for cancer, sickle cell disease, and lupus.
NEVADA
The state of Nevada has introduced Assembly Bill 428 mandating insurance coverage for breast cancer and gynecological cancer patients’ fertility preservation.
NEW JERSEY
New Jersey has introduced legislation (S3831) which would require Medicaid and Plan First to cover standard fertility preservation services to those at risk of iatrogenic infertility due to medically necessary treatment. This bill is still pending and is not yet enacted. We are hopeful to receive updates shortly.
FLORIDA
On July 3, 2025, HB 677 was passed in Florida to mandate state group insurance plans cover standard fertility preservation services without requiring preauthorization!
As we look ahead to 2026, we are rallying our peeps in Pennsylvania and Arizona to introduce statewide legislation in these two new states!
